"Wellnessta" means Wellnessta Private Limited, a corporation organized under the Companies Act; authorized to carry on business in India to carry on the business of providing all types of e-commerce services including providing cloud software, buying and selling of solutions and options and related consultancy services either directly or indirectly or through brokers or licensees and also providing franchising and management services, publishing content online, print or any medium in India or outside India either singly or jointly or in Partnership with any person(s) or Body corporate or partnership Firm and “Wellnessta Platform” (which includes any of Wellnessta’s websites and mobile applications. By making a booking or reservation request through Wellnessta, you accept and agree to the cancellation and no-show policy of Wellnessta and to any additional (delivery) terms and conditions that maybe be relevant and may apply to your booking included services rendered or products offered. Wellnessta reserves the right to change these terms and conditions from time to time in its discretion and without prior notice to you. 1. GENERAL 

 

Booking, reservations and amendments are subject to availability of rooms or seats with service providers. Wellnessta does not any point guarantees or promises to provide any reservation.  



2. MODE OF CANCELLATION


2.1. Cancellations can be made through by pressing “Cancel” button  provided along the booking history on Wellnessta Platform.


2.2. No cancellation shall be accepted over email, phone call or any other means except as per Clause 2.1 above. 

 

3. CANCELLATION AND REFUNDS

 

3.1. The following conditions shall apply in case of cancellation: 

 

Within Twenty-Four (24) hours of booking confirmation / until payment is not made

 

Free cancellation

Ten (10) days prior to check-in

Free Cancellation. Full Amount refundable except convenience fee. 

 

Five (5) to Ten (10) days prior to check-in

Twenty percent (20 %) amount refundable except convenience fee.

 

Zero (0) to Two (2) days prior to check-in / No-Show

Non-Refundable. 

 

3.2. Convenience fee once paid shall not be refunded under any circumstances. 


3.3. Bookings under any other offers / special offers as may be prescribed shall not be eligible for cancellation, refund or amendments. Please note that it is not possible to cancel a reservation made on a special promotional offer. Online bookings on discounted rates for promotional offers are Non-Cancellable/ Non-Changeable and Non-Refundable. 


3.4. Customers are required to check the reservation details thoroughly for any conditions prior to making any payments. 


3.5. Wellnessta shall help guests find a new place on other available dates or issue a refund if the property is inaccessible, or unsafe. 


3.6. Wellnessta shall refund full amount if cancellation is made from the thirty-party service provider authorized by Wellnessta or Wellnessta subjected to Clause 3.1 above. 


3.7. Late payment, wrong bank, debit or credit card details, invalid credit/ debit cards, or charges concerning insufficient funds are at customer’s own risk and account, and thus will not be entitled to any refund of any (non-refundable) prepaid amount unless the Wellnessta agrees or allows otherwise under its payment and cancellation policy. 


3.8. Should the cancellation not be made accordingly, Wellnessta shall not to be held liable or responsible for eventual penalties charged to the credit card/ debit card/ your account. 


3.9. On cancellation, the money will be credited to the same account used while making the booking. For example, if a credit card was used, the appropriate charge reversal will be made. If a debit card was used, the money will be credited back to the debit card. 


3.10 The refund will be processed within two (2) weeks. Depending on the bank, the refund may take slightly longer to reflect in the account statement. Usually this may take about 3-5 working days or more for refunds to reflect their respective accounts.


4. POSTPONEMENT / RESCHEDULING RULES:


Rescheduling is permitted free of cost only for one time, provided it is requested before two or more than two weeks prior to check in date/time. (Once rescheduled, there will be no further change or cancellation will be permitted). Wellnessta may permit further change or cancellation at an extra or additional cost which shall be determined by Wellnessta at the time of such request. However, Wellnessta’s decision to permit or to reject such request shall be at Wellnessta’s sole discretion and shall be final, conclusive and binding. 

 

 

5. DISPUTE RESOLUTION AND ARBITRATION

All disputes arising out of this Program shall be referred to arbitration under Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment thereof for the time being in force. The arbitration shall be referred to a sole arbitrator who is on the panel of the Indian Merchant Chamber. The venue of Arbitration will be Mumbai and the language of the proceedings shall be English.  

 

 

6. GOVERNING LAWS AND JURISDICTION

These Terms and Conditions are governed by and is to be construed in accordance with the laws of the Republic of India. The Courts in Mumbai shall have exclusive jurisdiction.
