"Wellnessta" means Wellnessta Private Limited, a corporation organized under the Companies Act; authorized to carry on business in India for to carry on the business of providing all types of e-commerce services including providing cloud software, buying and selling of solutions and options, and related consultancy services either directly or indirectly or through brokers or licensees and also providing franchising and management services, publishing content online, print or any medium in India or outside India either singly or jointly or in Partnership with any person(s) or Body corporate or partnership Firm and “Wellnessta Platform” (which includes any of Wellnessta’s websites and mobile applications. By making a booking or reservation request through Wellnessta, the user (“User”)  accepts and agrees to the refund and cancellation policy of Wellnessta and to any additional terms and conditions that maybe be relevant and may apply to your booking including services rendered or products offered. Wellnessta reserves the right to change these terms and conditions (“Terms and Conditions”) of the policy from time to time in its discretion and without prior notice to you. 1. MODE OF CANCELLATION 

 

1.1. Cancellations can only be made through by pressing “Cancel” button provided along the booking history on Wellnessta Platform.


1.2. No cancellation shall be accepted over email, phone call, or communicated using any other means. 

 

 

2. CANCELLATION AND REFUNDS

 

2.1. IN CASE OF TIMED OR DATED APPOINTMENTS AND RESERVATIONS, the following conditions shall apply in case of cancellation: 


2.1.1. Wellnessta offers cancellation Two (2) hours prior to the time of appointment. A Cancellation two (2) hours prior to the appointment time is a Hundred percent (100%) refundable (excluding convenience fee) of booked service amount.


2.1.2. Some Vendors / Stores / Third Party Merchants (“TPM”) may offer 12 hours or 6 hours cancellation policy, the specific cancellation policy is stated on the booking confirmation page.


2.1.3. Amendments / Cancellation within two (2) hours is not permitted, however, it shall be at the discretion of the  TPM to accommodate such requests. Such requests are required to be made directly to the concerned TPM. 

 

2.2. For Wellnessta Vouchers and Deal Coupons, Gift Cards (“Coupons / Cards”), Wellnessta does not offer any cancellation. No Amount will be refunded once a gift card is purchased. Vouchers, Deal Coupons and Gift cards offered and sold by TPM on Wellnessta are subject to TPM’s terms and conditions and TPM may not accept any refunds. Please refer the terms and conditions on the TPM’s page prior to purchase. 


2.3. A Coupon / Card cannot be refunded once redeemed or purchased.


2.4. No-show appointments for online payments are non-refundable. 


2.5. Handling Charges/ Convenience fees/ Service Fee, if charges at the time of booking shall not be refundable in case the booking is canceled by the customer. 


2.6. Any other offers/ special offers as may be prescribed shall not be eligible for cancellation, refund, or amendments. Please note that it is not possible to cancel a reservation made on a special promotional offer. Online bookings on discounted rates for promotional offers are Non-Cancellable/ Non-Changeable and Non-Refundable. 


2.7. Late payment, wrong bank, debit or credit card details, invalid credit/ debit cards, or charges concerning insufficient funds are at the customer’s own risk and account, and thus will not be entitled to any refund of any (non-refundable) prepaid amount unless the Wellnessta agrees or allows otherwise under its payment and cancellation policy. 


2.8. Should the cancellation not be made accordingly, Wellnessta shall not to be held responsible for eventual penalties charged to the credit card. 


2.9. On cancellation, the money will be credited to the same account used while making the booking. For example, if a credit card was used, the appropriate charge reversal will be made. If a debit card was used, the money will be credited back to the debit card. 

The refund will be processed within two (2) weeks. Depending on the bank, the refund may take slightly longer to reflect in the account statement. Usually, this may take about 5-7 working days or more for refunds to reflect their respective accounts.

 

 

3. DISPUTE RESOLUTION AND ARBITRATION

 

All disputes arising out of this Program shall be referred to arbitration under Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment thereof for the time being in force. The arbitration shall be referred to a sole arbitrator who is on the panel of the Indian Merchant Chamber. The venue of Arbitration will be Mumbai and the language of the proceedings shall be English.  

 

 

GOVERNING LAWS AND JURISDICTION

 

These Terms and Conditions are governed by and are to be construed in accordance with the laws of the Republic of India. The Courts in Mumbai shall have exclusive jurisdiction.
