These Terms and Conditions ("Terms") govern your use of the Paynessta payment link ("Service"), which is provided by the Salon or Spa outlet (the "Vendor") where you booked your appointment and powered by Wellnessta.com. By clicking the payment link and making a payment, you (“Customer”) agree to be bound by these Terms. If you do not agree with these Terms, please do not use the payment link.
1. Acceptance of Terms and User Registration
1.1. Acceptance: By initiating a transaction via the Paynessta payment link, you confirm that you have read, understood, and agree to be bound by these Terms.
1.2. Scope: These Terms apply solely to the payment processing service provided through the Paynessta link and do not affect any separate terms or conditions related to the actual services provided by the Vendor.
1.3. If you are already a registered user, your continued use of the Paynessta service confirms your acceptance of any updated terms.
2. Payment Processing
2.1. Secure Processing:
All payments made via the Paynessta payment link are processed securely through a third-party Payment Gateway. By using the Service, you consent to the processing of your payment details by the Payment Gateway in accordance with its own privacy and security practices.
2.2. Settlement:
While you will receive an immediate confirmation of your payment, funds will be settled according to the Payment Gateway’s schedule—typically on Transaction Date +2 days (excluding bank holidays). The Vendor’s final receipt of funds is subject to this settlement period.
3. Third-Party Payment Gateway
3.1. The Payment Gateway is a third-party service provider. Wellnessta and the Vendor do not control and are not responsible for any delays, interruptions, or errors caused by the Payment Gateway’s systems or policies.
3.2. Any issues related to the processing of your payment should first be directed to the Payment Gateway’s customer support as per their guidelines.
4. Service Quality and Disputes
4.1. Vendor Services:
The Service provided by the Vendor (e.g., the quality of the service you receive) is independent of the Paynessta payment process. Any dispute regarding the quality, timeliness, or performance of the Vendor’s services must be resolved directly with the Vendor.
4.2. Payment Disputes:
In the event of a payment dispute, you agree to contact the Vendor directly for resolution. Neither Wellnessta nor the Payment Gateway shall be held liable for disputes regarding the Vendor’s service delivery or any related dissatisfaction.
5. Data Privacy and Security
5.1. All personal and payment information you provide when using the Paynessta link is handled in accordance with Wellnessta’s Privacy Policy and the Payment Gateway’s data protection practices. 5.2. By using the Service, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

6. Limitation of Liability

Wellnessta, the Vendor, and the Payment Gateway shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Paynessta payment link, including any loss of revenue, loss of data, or interruption/quality in service.
6.2. Service Disputes:
In no event shall Wellnessta be liable for any disputes, claims, or losses arising out of or related to deficiencies in the Vendor’s service, or for any claims brought by you against the Vendor regarding the quality or performance of the service provided.
6.3. Aggregate Liability:
Our total liability, whether in contract, tort, or otherwise, shall not exceed the amount processed in connection with your transaction.
6.4. Additional Charges:
Wellnessta is not liable for any additional charges levied by banks or card providers, including but not limited to forex charges.
7. Indemnification
You agree to indemnify, defend, and hold harmless Wellnessta, the Vendor, and the Payment Gateway (and their respective officers, directors, employees, and agents) from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to your use of the Paynessta payment link or your violation of these Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
9. Arbitration
9.1. Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or invalidity thereof, shall be resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
9.2. The venue for arbitration shall be Mumbai, India. The arbitration proceedings shall be conducted in English, and the arbitrator’s decision shall be final and binding upon you.
10. Modifications and Discontinuation of Service

10.2. Discontinuation:
Wellnessta reserves the right to suspend, modify, or discontinue the Paynessta payment link feature, in whole or in part, at any time and without prior notice. Neither Wellnessta nor the Vendor shall be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
11. Refund Policy
11.1. Initiation of Refunds:
In the event that a refund is required—for example, due to a processing error or other circumstances as determined by the Vendor or Wellnessta—a refund will be initiated in accordance with the applicable policies.
11.2. Processing Time:
Refunds may take 5-7 working days (excluding bank holidays) to be processed. Please note that this timeframe is subject to the policies and processing times of the Payment Gateway, and any delays beyond this period are not within the control of Wellnessta or the Vendor.
11.3. Refund Inquiries:
Any inquiries regarding the status of a refund should be directed to the Vendor’s customer support, or as otherwise communicated by Wellnessta.
11.4. Refund Denial:
Wellnessta reserves the right to deny refunds in cases of policy violations or fraudulent activities.
12. Acceptance
By clicking the payment button and completing your transaction, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including the binding registration as a user of Wellnessta.com as described above.
